The claim process, step by step

Every claim is different, but the process generally follows the same path:

  • Seek medical attention — your health first; treatment records also become key evidence
  • Report the incident — to the property owner, manager or relevant authority, creating a documentation trail
  • Gather evidence — photos of the scene, witness statements, medical records and related documents
  • Consult ROC Legal — we assess the strength of your case and guide you through the process
  • Lodge a Notice of Claim — we prepare and serve it on the negligent party or their insurer
  • Negotiation or court — most claims settle through negotiation; we’re ready to litigate if needed

Once the claim is served, negotiations with the other party’s insurer usually follow. If a fair settlement can’t be reached, we’ll advise you honestly about taking the claim further.
